Terms of Service

Effective July 2026. Questions: support@primerow.app. Please read these Terms carefully: they include a binding arbitration agreement and a class-action waiver (Section 13) and limit our liability (Sections 11 and 12).

1. Who we are, and accepting these Terms

PrimeRow ("PrimeRow", "we", "us", "our") is an independently operated alert service. These Terms of Service are a binding agreement between you and the operator of PrimeRow. By creating a watch, buying a credit, or otherwise using PrimeRow, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the service.

2. Eligibility

PrimeRow is for users 13 years of age or older. By using PrimeRow you represent that you are at least 13 and that you are able to enter into this agreement (if you are under the age of majority where you live, that a parent or guardian agrees on your behalf). We do not knowingly collect data from children under 13.

3. What PrimeRow is, and is not

PrimeRow is an alert-only monitoring service. We watch publicly available seat-availability pages for showtimes you select and notify you when seats matching your stated preferences appear. That is the entire service. You are paying for the monitoring service, not for a ticket, a seat, or any guaranteed outcome.

We never buy, hold, reserve, or resell tickets, and we never act on your behalf at any theater or ticketing platform. When you receive an alert, you buy your own ticket directly from the theater or its ticketing provider, at that provider's price. PrimeRow is not a ticket seller, broker, reseller, agent, or marketplace.

4. No affiliation

Not affiliated with any theater, studio, or ticketing platform. All venue, chain, film, and platform names, where they appear, are used only to describe what you are watching. We claim no partnership, sponsorship, or endorsement by any of them, and none is implied.

5. Watches and credits

A watch is one showtime-set plus one seat-preference rule, monitored until the show starts or you cancel. A date range covering many showtimes at one theater counts as one watch. You buy watches as credits ($2.99 for one, $7.99 for three, $19.99 for ten). Credits do not expire and have no cash value.

6. The guarantee, and how a credit is consumed

If a watch's dates pass and we never sent you an alert for seats meeting your minimum tier, we automatically return the credit. No request is needed. For web purchases you may instead request a refund to your card (see the Refund Policy). This return of credit is the sole and exclusive remedy for a watch that did not produce a matching-seat alert.

An alert fired = watch consumed. Once we send you a qualifying alert, that watch has done its job and the credit is spent, whether or not you complete a purchase, and whether or not the seat is still available when you act. Seats reopen and resell on the theater's timeline, not ours. Alerts sent only in reduced-fidelity ("degraded") mode, which report a sellout change rather than a specific qualifying seat, do not count as a fired alert for the guarantee. Non-receipt of an alert that our records show was sent is not grounds for a refund.

7. Cancellation

You may cancel any active watch from your status link. If you cancel within one hour of purchase and before any alert has fired, your credit is returned automatically. After the first hour, or once any alert has fired, the credit is not returned.

8. Acceptable use

You will not resell, redistribute, or scrape PrimeRow alerts; use the service to facilitate ticket scalping or any unlawful purpose; or attempt to overload, probe, or reverse-engineer the service. Alerts are for your personal, non-commercial use in buying tickets. We may suspend or terminate accounts that violate these Terms, at our discretion.

9. Availability and accuracy

Seat data comes from third-party pages that can change, break, rate-limit, or go dark without notice, and alert delivery depends on third-party systems (Apple, email providers, and mobile carriers). We work to keep alerts fast and accurate, but we do not warrant that any seat will be available when you act, that every reopening will be detected, or that any alert will be delivered, delivered on time, or received. When a data source is unavailable, affected watches are paused and their time extended by the outage.

10. Payment

In the mobile app, credits are sold through Apple In-App Purchase and billed to your Apple ID; Apple's terms and refund process apply. On the web, payments are processed by Stripe; we never see or store your card details. Applicable sales tax is calculated and collected at checkout. Except as stated in Sections 6 and 7 or as required by law, all sales are final.

11. Disclaimer of warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. We do not warrant that the service will be uninterrupted, timely, secure, error-free, or that seats will become available. Some jurisdictions do not allow the exclusion of certain warranties, so parts of this section may not apply to you.

12. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PRIMEROW AND ITS OPERATOR WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF TICKETS, SEATS, PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE SERVICE. Our total aggregate liability for all claims relating to the service is limited to the greater of (a) the amount you paid us in the three months before the event giving rise to the claim, or (b) US $20. We are not responsible for ticket prices, sold-out shows, or the acts, omissions, prices, or policies of any theater or ticketing provider. These limits apply even if a remedy fails of its essential purpose.

13. Dispute resolution: binding arbitration and class-action waiver

Please read this section carefully — it affects your legal rights. You and PrimeRow agree that any dispute, claim, or controversy arising out of or relating to these Terms or the service will be resolved by binding individual arbitration, and not in court, except that either party may bring an individual claim in small-claims court. The arbitration will be administered by a recognized arbitration provider under its consumer rules, and may be conducted by phone, video, or written submissions. You and PrimeRow waive any right to a jury trial and any right to participate in a class, collective, or representative action. Claims may be brought only in your individual capacity.

30-day opt-out: you may opt out of this arbitration agreement by emailing support@primerow.app within 30 days of first accepting these Terms, stating your name and that you opt out of arbitration.

14. Indemnification

You agree to indemnify and hold harmless PrimeRow and its operator from any claims, losses, or expenses (including reasonable legal fees) arising from your misuse of the service or your violation of these Terms or of any law or third-party right.

15. Governing law

These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules, and, for any matter not subject to arbitration, you consent to the exclusive jurisdiction of the state and federal courts located there.

16. Changes to these Terms

We may update these Terms from time to time. Material changes take effect when we post the updated Terms here and update the effective date. Your continued use after that constitutes acceptance. If you do not agree, stop using the service.
